These Terms of Service ("Terms") govern your access to and use of the Ascent Solutions Group website and the AI-powered after-hours answering service ("Services"). By using our website or enrolling in the Services, you agree to these Terms. The Services are also governed by the separate written Client Service Agreement you sign; if there is a conflict, the signed Service Agreement controls.
1. The Services
We provide an AI-powered telephone answering service that receives inbound calls forwarded from a client's line(s), collects caller information (name, callback number, service address, and a description of the issue), notes urgency based on the caller's responses, and delivers a structured summary to the client by SMS and/or email. The Services are an information-relay and lead-capture tool only. We do not dispatch technicians, perform plumbing work, or guarantee call outcomes.
2. Not an emergency or 911 service
The Services are NOT an emergency service and are NOT a substitute for 911. The AI classifies calls based only on a caller's spoken responses and may misclassify, delay, or fail to capture a call. We do not monitor calls in real time and do not guarantee that any call — including one involving flooding, gas, fire, or other danger — will be answered, correctly classified, or delivered. Anyone experiencing a life-threatening or property-threatening emergency must contact 911 or the appropriate utility or emergency provider directly.
3. Eligibility
You must be a business and at least 18 years old, and able to enter into a binding contract, to use the Services.
4. Plans, fees, and billing
- Plans: Starter $149/mo (up to 75 after-hours calls), Standard $249/mo (up to 150), and Pro $349/mo (up to 300). A one-time $99 setup fee applies to all plans.
- Overage: calls above the monthly allotment are billed at the plan's per-call overage rate (Starter $3.00, Standard $2.50, Pro $2.00). We do not drop calls for exceeding a plan limit.
- Billing: monthly fees are billed in advance on each monthly anniversary of your effective date; overages are billed in arrears. By enrolling, you authorize us and our payment processor to charge your payment method on file for all fees, including renewals and overages, until cancelled.
- Late/failed payment: past-due amounts may accrue a late charge and the Services may be suspended after notice until the balance is paid.
5. Term, renewal, and cancellation
Plans are billed monthly and automatically renew for successive one-month periods at the then-current rates unless cancelled. Either party may cancel with at least thirty (30) days' written notice (email is sufficient). The $99 setup fee is non-refundable once account configuration begins.
6. Client responsibilities
- Configure call forwarding from your line(s) to the number we provide.
- Keep a current payment method and contact details on file.
- Promptly monitor and act on the call summaries we deliver, including returning calls to customers.
- Obtain any consents required for us to text or email information about your callers.
We are not responsible for delays or failures caused by your phone carrier, forwarding misconfiguration, incorrect contact information, or your failure to act on a delivered summary.
7. SMS and communications
Your use of SMS alerts is subject to our SMS Terms and Privacy Policy. Consent to receive SMS is not a condition of purchasing the Services, and you may opt out by replying STOP.
8. Acceptable use
You agree not to use the Services unlawfully, to send unsolicited or non-compliant messages, to infringe others' rights, or to interfere with or attempt to disrupt the Services.
9. Disclaimer of warranties
The Services and website are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that every call will be captured or correctly classified.
10. Limitation of liability
To the maximum extent permitted by law, Ascent Solutions Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or related to the Services. Our total liability for any claim will not exceed the fees you paid us for the Services in the month in which the claim arose.
11. Indemnification
You agree to indemnify and hold harmless Ascent Solutions Group from claims arising out of your use of the Services, your customers' calls, or your failure to obtain required consents or to act on delivered summaries.
12. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the Services after changes take effect constitutes acceptance.
